 Lake Wales Child Sexual Battery Suspect Located in Virginia 

Polk County Sheriff’s Office detectives, working with the U.S. Marshals Florida Regional Fugitive Task Force, located a Lake Wales Sexual Battery suspect whose wife lied repeatedly to law enforcement to conceal his whereabouts.

Wanted for 2 counts of Sexual Battery on a child less than 12 years of age, and Distributing Obscene Material to a Minor since January 24, 2013, 68-year-old Charles Luther Bailey 03/25/44, previously living in the Walk in Water Road area of Lake Wales, was located at a residence in Dry Fork, Virginia.  According to affidavits, Bailey repeatedly, over several years, sexually battered two girls.

“The US Marshals are outstanding partners.  The Marshal’s Florida Regional Fugitive Task Force has been invaluable in hunting down criminals who are trying hard not to be found.  Their skill in finding fugitives across jurisdictions, working with our detectives, is second to none.  Finding Charles Bailey is a great example of the Task Forces’ dogged determination to hunt bad guys.  Bailey will now face prosecution and accountability for his crimes.”  Sheriff Grady Judd

When Bailey first learned of the investigation in 2013, he fled the area.  Two days later, on January 26th, the suspect’s wife, Viola Bailey, reported the suspect missing to the Manatee County Sheriff’s Office advising MCSO deputies her husband was last seen in Duette.  Viola told MCSO deputies the couple stopped at a store in Duette, and Charles fled with a pistol, threatening to kill himself.

Through their investigation, MCSO detectives determined Viola Bailey had lied about her husband’s disappearance and instead had dropped Charles off at the intersection of SR 301 and CR 62 (Parish, Florida).  Viola was subsequently charged with Filing a False Police Report; Charles Bailey’s whereabouts have been sought since.

Working with the U.S. Marshals’ Office, investigators learned Viola had been making trips to Dry Fork Virginia.  Through coordination with members of the US Marshals Capitol Area Regional Fugitive Task Force in Roanoke, investigators initiated contact at a residence located at 1050 Sportsman Road in Dry Fork, Virginia, where both Charles and Viola were found. 

Polk County Sheriff’s Office detectives are currently in the process of obtaining a Governor’s Warrant to aid in the extradition process.

Bailey has been booked into the Pittsylvania County Jail 11 Bank Street, Chatham, VA, 24531, on the Polk County Warrant – Custodial Sexual Battery (3 Counts), Exhibition of Pornographic Material to Minors (2 Counts), Lewd/Lascivious Molestation, with a No Bond status.
