 Polk County Sheriff's Office Dive Team recovers body in Lake Starr near Lake Wales - apparent accidental drowning 

PCSO Dive Team members recovered the body of 22-year-old Cody Allen Hayes (DOB 06/06/1988) of 170 Spurlock Road, Frostproof, out of Lake Starr near Lake Wales on December 26, 2010, at about 11:30 a.m.  Divers were called out after Hayes did not return to shore after a canoe he was in turned over. 

Hayes and Michael Paul Duey of Tower Manor MHP, Lot #1, Auburndale went out onto Lake Starr to fish in a canoe around at around midnight, December 26, 2010.  While in the middle of the lake, the canoe tipped over knocking both men into the water.  Duey told deputies that he was able to swim to shore, however, Cody Hayes was having difficulty swimming. 

Duey stated that the water was freezing cold and he could barely swim to shore and could not help Hayes.  Duey stated that as soon as he made it to shore he went to his sisters' house at 3056 Lindsey Drive off of Lake Starr and had her call the Sheriff's Office. 

There were flotation devices in the canoe but neither man was wearing a life vest.  The Lake Wales Fire Department responded, launched their boat, but was unsuccessful in locating Cody Hayes.  The PCSO Marine Unit also responded. 

Cody Hayes' body was found and recovered at about 11:30 a.m. Sunday morning, December 26th, 2010. It appears that Hayes likely drowned.  No foul play is suspected. The Medical Examiner's Office will conduct an autopsy to determine the exact cause and manner of death.
